Integration:
The Integration
Agreement of 2003 and the Memorandum of Understanding
( MOU) 2004 between
Revenue and IMPACT (TOB) provided for a transition period of four years at the
end of which all those remaining in the grades on Tax Officer and Higher Tax
Officer would be regraded to the general service grades of CO and EO
respectively. Re – certification for these grades took place on 1st
July 2007.
The 2003 Agreement and
the MOU 2004 also provided for the setting up of a review group (comprising of
Revenue management and IMPACT TOB in January 2007 to consider the scope for,
and possible mechanism whereby, a quantum of the staff remaining in the grade
of TO and HTO could aspire to be regraded to EO and HEO. One of the final acts
of the TOB was to conclude an agreement, which will see 30 Upgradings to EO and
HEO over three years commencing in the autumn of 2007. All of these new posts
will be assigned to Audit, Investigative and Compliance work.
As a result of this
agreement this
EO’s and Audit:
Under the PCW, agreement
was reached that allowed HTO’s to do some audit work. Clear parameters were set
out to distinguish what HTO’s could be asked to do and what work remained
proper to Inspectors. This distinction, at the time, was delineated on the
basis of financial limits--income up to £15k. and
turnover up to £100k, (in 1997 terms), and anything above this was proper to
Inspectors.
Section
1.9 of the Integration Agreement states ' It is not the intention that this
Agreement would be used as a basis to downgrade work i.e to assign work to a
lower grade where such work is not appropriate to and within the duties of the
grade involved.' This section also undertakes that 'Significant
changes will be the subject of discussions with the relevant Unions in
advance.'
Apparently, in May 2007
some members of Revenue Management declared that there was now '...no
restriction or limitations on the type of audits to be initiated or conducted
by HTO’s. In doing so, they cited the flexibility provisions in Section 2.21 of
'Towards 2016'.
It
needs to be stated at the outset that we accept the principles set out in that Section.
However, nowhere in that Section is there any agreement that previous
agreements can be set aside without consultation. Indeed, the terms of that
Section are very broad and open to a range of possible interpretations in any
given case. We do not accept that anything in that Section, when applied to
this issue, can be interpreted to mean that Revenue is entitled to cast aside
previous agreements, which provide a clear basis to distinguish between the
relevant grade levels. Both levels are now within the General Service and our
interests are in securing high-level work for the HEO grade and protecting
career outlets for our EO’s. We are not agreeable to the downgrading of HEO
work. Discussions are ongoing with HRD.
State Warehouse:
The Board of the Revenue
Commissioners gave approval late in 2006 to proceed with the outsourcing of the
State Warehouse functions under section 28.9 (service delivery options) of Towards 2016. Requests for tenders were issued in July 2007
and 5 tenders were received ahead of the closing date in September. Management
is now evaluating these tenders. Meetings took place between Management and the
Unions during 2007 at which the Unions voiced their opposition to the
outsourcing project. As agreement cannot be reached the matter is now being
referred to the public service sub – group of the National Implementation Body.
